Mobilize Participant Terms & Conditions

The 2019 22squared Mobilize Student Advertising Competition ("Competition") is sponsored by 22squared, inc. The Competition is governed by these official rules ("Rules"). By registering for and participating in the Competition, you agree to these Rules and understand that the results of the Competition, as determined by Sponsor, are final in all respects.

Eligibility

The Competition is open to legal residents of the 50 United States and DC, who are at least 18 years of age or older on the date of registration for the Competition. Employees, officers and directors of Sponsor, any participating non-profit or charitable organization, and their respective parent, subsidiaries, agents and suppliers, as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents) and individuals living in the same household as those individuals are not eligible to enter or win. Sponsor has the right to verify the eligibility of each registrant and to determine, in its sole discretion, whether a registrant is eligible for the Competition.

To be eligible, you must be able to be present at one of the designated Competition locations (either at Sponsor’s offices in Tampa located at 100 North Tampa Street, Suite 2500, Tampa, Florida 33602 or Sponsor’s offices in Atlanta located at 1170 Peachtree Street NE, Suite 1400, Atlanta, Georgia 30309) on February 8-10, 2019. Participants who are not present for all stages of the Competition may not be able to participate fully in the Competition and may not be eligible to receive any prizes.

Registration

To register for the Competition, access the website available at ​http://mobilize.22squared.com and follow the links and instructions provided to register as a potential participant. Registrations must be received by no later than 11:59 pm ET on November 30, 2018 to be considered for participation in the Competition. Registrations received between December 1, 2018 and February 7, 2019 may be placed on a wait list, if applicable. Only registrations that are completed and submitted according to the Rules and other instructions provided by Sponsor will be accepted. Receipt of registration may not be acknowledged, and proof of submission of a registration will not be deemed proof of receipt of registration by Sponsor. Any automated computer receipt (such as a "thanks for registering" message) does not constitute proof of actual receipt of registration by Sponsor. Sponsor has no obligation to advise you of an incomplete or otherwise non-compliant registration. Sponsor is not responsible for lost, late, invalid, unintelligible, incomplete, garbled, or misdirected registrations, which will be disqualified.

A total of approximately 50 participants will be selected by Sponsor from among eligible registrants to participate in the Competition, 25 individuals at each location, in its sole discretion, to fulfill the following roles on an advertising campaign team: "the storyteller," "the media planner," "the hustler," "the architect," and/or "the visionary." Eligible registrants selected to participate in the Competition will be notified on or around January 7, 2019 using the contact information provided during registration. Please note: Registrants may be asked to designate the location for which they are registering, and if selected, must participate in the Competition at the designated location. No travel or accommodations will be provided, paid for or reimbursed by Sponsor.

Conditions of Participation

Participants selected to participate in the Competition must be present during the entire Competition weekend. Upon arrival, participants will be divided into teams, as determined by Sponsor. Two non-profit organizations selected by 22squared will brief participants on an advertising need of the organization that it would like to see addressed. Each location will feature a different non-profit organization. Participants will then work in their teams to craft an advertising campaign that responds to that need (each campaign a "Submission").

Creative work must begin during the Competition weekend and teams must complete sufficient work to produce a minimum viable solution capable of demonstration to the judging panel at the end of the Competition weekend. By participating in the Competition, you represent and warrant the following: (a) all Submissions submitted by you are your original creations; (b) none of your entries have been copied in whole or in part from any other work; (c) your entries do not violate or infringe any copyright, trademark, or other proprietary right of any person or entity; (d) neither Sponsor nor any non-profit organization participating in the Competition will be obligated to pay any compensation to, or permit any participation by, any third party in connection with the use, reproduction, modification, publication, display or other exploitation of any of your Submission; and (e) the Submission submitted by you does not contain any viruses, Trojan horses, worms or other disabling devices or harmful code. Participants are liable for any damages inflicted upon the 22squared facilities or losses of 22squared property for which they are responsible during the course of the Competition.

GRANT OF RIGHTS

You hereby grant to Sponsor and the non-profit organization assigned to your team, without additional consideration, a worldwide, perpetual, irrevocable, non-exclusive right and license, with the right to sublicense, to reproduce, modify, publish, display and otherwise exploit your Submission, and any intellectual property rights therein. Except where prohibited, you hereby waive any and all so-called "moral rights" or any similar right that you may have or hereinafter acquire in the entry, and to the extent that you cannot, you hereby consent to Sponsor and the non-profit organization assigned to your developer team doing or omitting to do any act that would otherwise infringe such "moral rights" or any such similar rights. You agree to sign any necessary documentation that may be required for Sponsor and the non-profit organization assigned to your developer team and/or their designees to make use of the rights you granted above. You understand that you will not receive any compensation or credit for use of your Submission, other than what is described in these Rules.

Please note that all entrants retain ownership of the copyright in their Submissions, subject only to the license granted in these Rules. You understand and acknowledge, however, that Sponsor and the non-profit organization participating in the Competition and other entrants may have developed or commissioned materials similar or identical to Submissions and you waive any claims you may have resulting from any similarities to your Submission. You understand that we cannot control the incoming information you will disclose to our representatives in the course of entering, or what our representatives will remember about your Submission. You also understand that we will not restrict work assignments of representatives who have had access to your Submission. By entering this Competition, you agree that use of information in our representatives’ unaided memories in the development or deployment of our products or services does not create liability for us under these Rules or copyright or trade secret law. Sponsor does not wish to receive any application that you wish to treat as confidential or proprietary, so please do not submit anything of that nature to Sponsor or the non-profit organization assigned to your developer team and expect that it will be held in confidence by us or anyone else involved in the Competition.

Judging and Prizes

Each team may only submit one entry for judging at the end of the Competition. Submissions will be evaluated against other submissions at that location and judged by a panel of judges selected by Sponsor in its sole discretion, and may be comprised of Sponsor employees, employees of the participating non-profit organization and other industry professionals. The panel of judges will select one winning team based on the following judging criteria: 25% on design, 25% on execution, 25% on how well the solution meets the non-profit organization’s need, and 25% on creativity and innovation.

In the event of a tie, the judging panel will judge the tied entries again until a winning team is determined. All decisions of the judging panel are final and binding in all respects. The winning team will be announced on Sunday, February 10, 2019 at the end of the Competition. Prizes shall be awarded to the winning team at the event.

Sponsor will provide a maximum of 160 hours of graphic design and PR support to the winning teams, should the winning team complete development and launch a working solution. Such design and support will only be provided for further development of the winning Submission and not any other solution or application.

PRIZES:

Each member of the winning teams will receive a prize or prizes selected by Sponsor in its sole discretion (ARV to be determined).

Sponsor makes no warranties, representations or guarantees relative to any prize, and disclaims all liability for the provision, use, quality or nature of any third party product or service provided to the prize winner. Prize winners are responsible for all taxes resulting from acceptance and use of the prize, and all costs and expenses not specified as part of the prize. Except for the prize values, prize winner will not receive any additional monetary compensation or acknowledgement for participation in the Competition.

ADDITIONAL LIMITATIONS

Prizes are non-transferable except by Sponsor and must be accepted as awarded. Prizes cannot be used in conjunction with any other promotion or offer. No substitution or cash equivalent of a prize is permitted except in Sponsor’s sole discretion; however, Sponsor reserves the right to substitute any prize with another of equal or greater value. No winner is entitled to the difference between the approximate retail value and the actual value of any prize. Sponsor is not responsible for any typographical or other errors in the offer or administration of the Competition, including, but not limited to, errors in the printing or posting of the offer or Rules, the selection and announcement of any winner, or the distribution of prizes. Any attempt to damage the content or operation of the Competition is unlawful. Sponsor reserves the right, in its sole discretion, to modify, cancel, terminate or suspend this Competition if the it cannot be operated as planned or should virus, bugs or other causes beyond Sponsor’s control corrupt or impair the administration, security or proper play of this Competition. In such event, Sponsor reserves the right to void the entries at issue or cancel the Competition and select a winner from the eligible entries received up to the time of cancellation that have not been compromised. Sponsor will not replace any lost or stolen prize items. The Sponsor and any telephone network or service providers are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.

LIMITATION OF LIABILITY, INDEMNIFICATION AND RELEASE

BY ENTERING, YOU AGREE TO RELEASE, INDEMNIFY, REIMBURSE, DEFEND AND HOLD HARMLESS SPONSOR AND THE NON-PROFIT ORGANIZATIONS, CONTEST ADMINISTRATORS AND THEIR RESPECTIVE PARENTS, AFFILIATES AND SUBSIDIARY COMPANIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES AND AGENTS ("INDEMNIFIED PARTIES") FROM ANY CLAIMS, ACTIONS, LIABILITY, COSTS, DAMAGES, LOSSES, PENALTIES, FINES, JUDGMENTS, INJURY, FEES AND EXPENSES OF ANY KIND INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES AND COSTS (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES) WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), CONTRACT, WARRANTY, STRICT LIABILITY, RELIANCE OR UNDER ANY OTHER THEORY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM (I) YOUR SUBMISSION, (II) ANY BREACH OF THESE OFFICIAL RULES BY YOU, AND (III) PARTICIPATION IN THE COMPETITION AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON, AND WHETHER OR NOT THE INDEMNIFIED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE INDEMNIFIED PARTIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE.

YOU UNDERSTAND AND AGREE THAT YOUR USE OF ANY ELEMENTS OR MATERIALS PROVIDED BY SPONSOR OR THE NON-PROFIT ORGANIZATIONS IS AT YOUR OWN DISCRETION AND RISK. ANY ELEMENTS OR MATERIALS PROVIDED IN CONNECTION WITH THIS COMPETITION ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. YOU UNDERSTAND THAT THE INDEMNIFIED PARTIES MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE RELIABILITY, TIMELINESS, AVAILABILITY AND/OR PERFORMANCE OF ANY ELEMENT OR MATERIALS. THE INDEMNIFIED PARTIES DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM OR LOSS OF DATA RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE COMPETITION.

PRIVACY, PUBLICITY AND USE OF INFORMATION

By participating, you grant Sponsor and its affiliates, permission to use your name, likeness, or comments for publicity purposes without payment of additional consideration, except where prohibited by law. Personal information collected from participants during the Competition may be collected and used by Sponsor, non-profit organizations participating in the Competition and any third parties engaged by Sponsor for purposes of administration of the Contest and the fulfillment and verification of prize awards. You expressly consent to the use of your information by Sponsor and its advertising or promotion agencies for such purposes.

WHO WON

The winning team names may be available on the ​http://mobilize.22squared.com website following conclusion of the Competition.
